    These are some really good messages but what do I do? I lost 2 jobs because during the background checks
    a pending felony has come up. What do you think should be my next step?

    as we've already said, theres not too much you can do. You can either suck it up and keep trying. try telling the employer about it, or not. Or you can seek legal advice and determine what you can do in the eyes of the law.

    Beyond that, there really isnt anything we can advise you to do.

    He wouldn't be able to sue, he did not disclose it on his application, and if he is trying for something that has high security they don't have to hire him. Noone has to give him a job and there are plenty of excuses not to.

    i had a caution about 7 years ago. do i need to delclair this now or is it wiped after so may years?

    the caution should have been wiped by now (i was told stuff stays on record fro 5 years by the probabtion office). However a caution is not the sort of thing that should stop you being employed, being a convited burgler, mugger, murder etc would! Its the conviction that matters normally, and a caution is not a proper conviction but justa light telling off.

    I went to my lawyer and his advise to me was that I should plead out on the charges of battery on a eldery made
    against me he said it was not worth the risk of going to jail in the event that I was found guilty.
    He said if I would plead out that I would not have a felony conviction on my record but that my record would show a withold of adjudication on the battery charge which after completing probation would be removed.

    How likely is it that I could get a job in IT with such a charge on my record. Previous to this charge I have a DUI in 1991.
    which does not affect me getting a job because it is more than 13 years ago, but my lawyer did say that in order for
    the battery charge to be wiped clean after probation I had to get the DUI charge in 1991 off my record which he
    explained to me how to do and said it was ultimately up to the court but very possible.

    Right now I am looking for work with working with a job counselor that has companies that are known to find jobs for known convicted criminals.Very few of the jobs are IT jobs. How likely is that every day companies will hire me under my current conditions. What do you think?

    I'd say this was down to the attitude of each company. I know that some places will try and judge you on how you come across in an interview, even with that on your record.

    It just means that you have to try harder and longer while job searching. I'm sure you will find a place eventualy. After all, if I remember correctly, you *have* had some employment recently.

    First thing you need to do is to remove anything regarding this stuff from the Internet, particularly relating to what that charge was about. You might think you're anonymous... then, all of a sudden, you find out you AREN'T.

    If it's not on your record, then what's there for them to find out? Either you have been convicted of a felony, or you have not been convicted of a felony... and that's all most employers ask.

    Well as it stands my record will show I was arrested but not convicted of a a battery on a elderly felony.
    It will show a "withhold adjudication" of guilt or delinquency.Will employers still want to hire me will they look down on me. What do you think I have never been in a situation like this before.
