Warranty issues?

So i have an Acer aspire laptop, which has become warped, well i say that as thats the best way i can explain it. What i mean is, that instead of it sitting flush with a desk , i can see a gap where one of the rubber feet are supposed to sit, so much so that when i put my finger on the corner, the thing will move up and down etc, id say theres about 5mm clearance, which is a fair bit.

I havent dropped this so im presuming it may of overheated. The majority of the laptop is a black brushed metal finish, with a plastic base that has a rubber/matt coated base.

Ive raised a ticket with Acer, but im wondering if they will class this as a defect.

Has anyone had any similar situations like this, if so who was it with and how did you get on ????
