privacy policys and user submissions

Hi all

first off, sorry for my long absence on this site Been busy with my site which is finish... no really its completed but will explain now whys it put on hold.

are privacy polices compulsory on web domains? And I am allow to use the many privacy policy templates on the web? Or do I have to go far and say something a solicitor needs to put together?

The other problem I got is user submissions. What if a user uploads a file. or in this case, a flash game that he or she claims that its there own creation.
And then someone trys to claim falsely that its there game. How do you know who is right and who owns the file? would this become a further problem if another competitor site author created the game on a another site originally?
